This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.
Who This Notice Covers
This notice applies to Foundry Integrative Psychiatry and Wellness, PLLC and its workforce, including clinicians, administrative staff, contractors, and business associates who help Foundry provide health care, billing, operations, technology, communication, and record-management services.
Our Responsibilities
Foundry is required to:
- keep your protected health information private;
- give you this notice of our legal duties and privacy practices;
- follow the terms of the notice currently in effect;
- notify you if a breach occurs that may have compromised the privacy or security of your information; and
- not use or share your information except as described in this notice, as you authorize in writing, or as permitted or required by law.
How We May Use and Share Your Information
Treatment
We may use and share your health information to evaluate and treat you, coordinate your care, review medications and allergies, order or review labs, communicate with pharmacies, coordinate with your primary care provider or other clinicians, and make referrals when clinically appropriate.
Example: we may review your medication history, allergies, prior records, and lab results before making a psychiatric medication recommendation.
Payment
We may use and share your information to bill and collect payment from you, your health plan, or other responsible payers. This may include eligibility checks, claims, prior authorization, benefit review, payment posting, billing questions, and collection of patient-responsible balances.
Health Care Operations
We may use and share your information to run the practice, improve care quality, train staff, manage scheduling, maintain records, review documentation, conduct compliance activities, support technology systems, and evaluate service performance.
Appointment Reminders and Communications
We may contact you about appointments, scheduling, forms, billing, care coordination, treatment follow-up, portal messages, refill workflows, or administrative matters. Depending on the contact preferences you provide, this may include patient portal messages, telephone, voicemail, email, text message, mail, or other administrative communication. We use reasonable efforts to limit sensitive information in non-secure channels.
Business Associates
We may share information with vendors or service providers who help us operate the practice, such as electronic health record, billing, telehealth, secure messaging, payment processing, document management, and information technology vendors. These business associates must protect your information under HIPAA and their agreements with Foundry.
Uses and Disclosures That May Be Required or Permitted By Law
We may use or share your information when permitted or required by law, including:
- to prevent or respond to a serious and imminent threat to health or safety;
- to report suspected abuse, neglect, or domestic violence when required or permitted by law;
- for public health activities, such as disease reporting or product safety;
- for health oversight activities, such as audits, investigations, inspections, or licensure;
- in response to a court order, subpoena, or other lawful process when requirements are met;
- for workers' compensation or similar programs when applicable;
- with law enforcement in limited circumstances permitted by law;
- with coroners, medical examiners, or funeral directors when applicable;
- for organ or tissue donation organizations when applicable;
- for specialized government functions when applicable; and
- as otherwise required by federal or state law.
Uses and Disclosures Requiring Written Authorization
We will not use or disclose your information for the following without your written authorization unless an exception applies:
- most uses and disclosures of psychotherapy notes;
- marketing communications that require authorization;
- sale of your protected health information; and
- disclosures to outside people or organizations when a valid release or authorization is required.
You may revoke an authorization in writing at any time, except to the extent Foundry has already acted in reliance on it.
Sensitive Information
Foundry provides psychiatric care. Your record may include sensitive information such as mental health history, medication history, substance-use history, trauma history, reproductive or hormonal health information, laboratory information, controlled-medication monitoring, or information from other clinicians. We use this information for treatment, payment, operations, and other permitted purposes described in this notice.
Psychotherapy notes — a clinician's private notes about a counseling session, kept separate from the rest of your medical record — receive extra protection under federal law. We generally will not use or share psychotherapy notes without your written authorization, except in limited situations allowed by law.
Where Massachusetts or Rhode Island law gives your mental health or substance use information more protection than federal law, Foundry follows the law that protects you more.
Substance Use Disorder Records
Some substance use disorder records may receive additional protection under 42 CFR Part 2. Foundry's launch posture is recovery-supportive outpatient psychiatric care, not a dedicated Part 2 substance use disorder treatment program. If Foundry requests, receives, uses, or discloses records that are protected by Part 2, Foundry will use the applicable Part 2 authorization and notice workflow. Foundry does not use a general release of information as a substitute for a required Part 2 authorization.
Reproductive Health Information
Foundry will follow applicable HIPAA reproductive-health privacy requirements. If a law requires an attestation before Foundry may disclose reproductive-health-related information for certain legal or investigative purposes, Foundry will require the attestation before making the disclosure.
Your Rights
You have the right to:
- get an electronic or paper copy of your medical record, subject to limited exceptions;
- ask us to correct your record if you believe it is inaccurate or incomplete;
- request confidential communications, such as asking us to contact you at a specific address or phone number;
- ask us to limit what we use or share, although we are not always required to agree;
- ask us not to share information about a service with your health plan when you have paid for that service in full, out of your own pocket — we will agree to this request unless the law requires otherwise;
- receive a list of certain disclosures we have made;
- receive a paper copy of this notice;
- choose someone to act for you if they have legal authority; and
- file a complaint if you believe your privacy rights have been violated.

Your Choices
In certain situations, you may tell us your preferences about sharing information. For example, you may tell us how to contact you, whether we may leave voicemail messages, whether we may communicate with family or support people involved in your care, and whether you authorize release of information to another clinician or organization. If you cannot tell us your preference, we may share information if we believe it is in your best interest or needed to lessen a serious threat.
Complaints
You may complain to Foundry if you believe your privacy rights have been violated. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. Foundry will not retaliate against you for filing a complaint.

Changes To This Notice
Foundry may change the terms of this notice. The new notice will apply to information we already have and information we receive in the future. Foundry will make the current notice available on request and post it where patients can access it electronically if Foundry maintains a website or patient-facing online service.
